Mylan Pharmaceuticals ULC (“Mylan Canada”) Privacy Policy for Canadian Residents*

The Privacy Policy explains how Mylan Canada may collect, use, and disclose Personal Information we obtain through our Mylan Health Coach website, http://www.mylanheatlhcoach.com (the “Site”) or otherwise through your participation in the Mylan Health Coach program.

By using the Site or otherwise participating in the Mylan Health Coach program, you agree to the terms of this Privacy Policy, and you consent to the collection, use and disclosure of personal information described in this Privacy Policy.

DEFINITIONS

Mylan Canada,” “we” and “us” includes Mylan Pharmaceuticals ULC, our parent company, Mylan Inc., and our affiliates and subsidiaries. 

Personal Information” means information that alone or when in combination with other information may be used to identify, contact or locate you, such as: name, address, email address or phone number, as well as other personal information, such as: your personal health information (e.g., blood pressure, medical history and lifestyle factors).

Neither the Site nor Mylan Canada provide medical advice. Mylan Canada is not engaged in the practice of medicine, and the information on the Site is strictly intended for informational and educational purposes. You should not use the Site to diagnose, treat, or mitigate any disease, disorder or abnormal physical state or prescribe any medication or treatment for yourself or any other person.  For greater certainty, the Site itself is not to be used in the diagnosis, treatment, mitigation or prevention of a medical condition. Through the Site, you may have access to or be able to communicate with a Registered Dietitian (“RD”).  The RD is an independent contractor and is not Mylan Canada’s employee, agent or representative. Your communication with the RD and your reliance on any statement or recommendation made by the RD is at your own risk. 

HOW THE SITE COLLECTS YOUR INFORMATION

We collect Personal Information when you:

  • use the Site;
  • communicate with us; or
  • participate in the Mylan Health Coach program.

Using the Site.  We collect information you post or provide on the Site or through your participation in the Mylan Health Coach program. For example:

  • We collect Personal Information such as your name and email address when you respond to surveys, request information from us, sign up to receive Mylan Canada’s newsletters, or otherwise interact with us online.
  • We collect certain Personal Information when you register for access to the Member’s portal.
  • We collect Personal Information when you post comments or communicate with others such as the RD within the Member’s portal; however, information that you provide in the Member’s portal is not made visible to anyone other than you or the RD unless you direct or share that information to someone else.  
  • We collect Personal Information that you provide to a RD through your participation in an RD assessment.  The information the RD collects from you will be entered in and stored in a secure portal within the Site (which is hosted by a third-party service provider) by the RD, and this information will only be visible to the RD.  Mylan Canada will not, and does not, have access or visibility to your health information, including any information that you provide to the RD, unless you authorize such disclosure. 

Customer Relations We may collect Personal Information (such as your name and e-mail address) through your communications with our customer relations team or any third party that you direct your Personal Information to, such as your local pharmacy or dietitian. 

Cookies, Automatic Data Collection and Related Technologies The Site may collect and store information that is generated automatically as you use it, including your preferences and anonymous usage statistics.

When you visit the Site, we and our third-party service providers may receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. These statistics help us to better understand how our Site is used and to allow us to change the Site to meet visitors’ needs.  This type of information is never linked to personally identifiable information.  

Most browsers allow you to block and delete cookies. However, if you do that, the Site may not work properly. 

By using the Site, you are authorizing us to gather, parse and retain data related to the provision of the Site.

HOW MYLAN CANADA USES YOUR INFORMATION 

We use Personal Information to:

  • operate and provide the Mylan Health Coach program;
  • facilitate and improve our services;
  • communicate with you; and
  • respond to your request for information unless otherwise required by law, regulation or governmental audit.

Internal and Service-Related Usage We use information, including Personal Information, for internal and service-related purposes and may provide it to third parties to allow us to facilitate, maintain and operate the Site. We may use and retain any data we collect to provide and improve our services.

Communications We may send emails, such as company news, updates or service information, to the email address you have provided, through registration or sign-up.  You can opt out of these communications as indicated in those communications or by contacting us in writing at the address set out at the end of this Privacy Policy. If you register as a Member on the Site, your RD may also communicate with you. 

MYLAN CANADA MAY DISCLOSE YOUR INFORMATION 

We may share your information:

  • with our third-party service providers;
  • to comply with legal obligations;
  • to protect and defend our rights and property; and
  • with your permission.

We do not rent, sell or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

We Use Vendors and Service Providers We may share any information we receive with vendors and service providers retained in connection with the provision of the Site and so that they may perform their obligations and responsibilities to us.  Any such third party retained will be required to enter into a confidentiality agreement providing that they agree to abide by the terms and conditions of this privacy policy and all applicable privacy laws.   

The Personal Information collected on our Site may be transferred to the United States for processing and storage, subject to applicable privacy laws. However, despite the previous sentence, any identifiable health information that you provide to the RD will only be stored in Canada (although anonymized health information that cannot be linked to you may be transferred to the United States for processing and storage).

Social Networking and Other Websites The Site may allow you to share information, including Personal Information, with social networking websites, such as Facebook. We do not share your Personal Information with them unless you direct the Site to share it. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

As Required By Law and Similar Disclosures We may access, preserve and disclose your Personal Information, other account information and content if we believe doing so is required or appropriate under Canadian, U.S. or other law to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect your, our or others’ rights, property or safety. We may also collect, use or disclose your Personal Information as otherwise required or permitted by applicable laws.

Merger, Sale, or Other Asset Transfers If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of Mylan Canada’s assets or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information after the completion of a transaction; however, in any such transfer, Mylan Canada will ensure compliance with all applicable laws.

SECURITY OF YOUR INFORMATION

We take steps to help ensure that your information is treated securely and in accordance with this Privacy Policy. We have implemented measures designed to protect Personal Information in our custody and control. We also maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of Personal Information.

Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

The safety and security of your Personal Information also depends on you.  Do not share your password with anyone.  We will never ask for this information from you.  Please notify Mylan Canada immediately if you believe that your password has been breached.   We also strongly recommend that you properly log off of the registered Site and close your browser window. 

CHILDREN'S PRIVACY

We do not knowingly collect information from children.  We will take steps to delete it if we learn we have collected it.

We do not knowingly collect, maintain or use Personal Information from children, and no part of the Site is directed to children. If you learn that your child has provided us with Personal Information without your consent, you may alert us at communications@mylan.com. If we learn that we have collected any Personal Information from children, we will promptly take steps to delete such information and terminate the child’s account.

LINKS TO OTHER WEBSITES

As a convenience to our visitors, the Site may contain links to the websites of another company or organization. When you click on one of these links, you will be transferred from our Site and be connected to the website of the company or organization you selected. Our Privacy Policy does not apply when you leave our Site.    

INTERNATIONAL USERS

The Personal Information collected on our Site may be transferred to Canada for processing and storage.

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to Canada, the United States and processing globally.  By providing your information or registering on our Site, you consent to any transfer, processing and storage in accordance with this Privacy Policy. You also acknowledge that applicable laws in jurisdictions to which your Personal Information is transferred might permit foreign governments, courts, law enforcement or regulatory agencies to access your Personal Information in those jurisdictions.

UPDATE YOUR INFORMATION OR POSE A QUESTION OR SUGGESTION

For those who have registered on the Site, you may make changes to your personal profile at any time via the Site.

If you would like to request access or update or correct any information that you have provided to us through your use of the Site or otherwise, or if you wish to delete any of your Personal Information from our Site (which may result in the termination of services or your participation in the Mylan Health Coach program), or if you have suggestions for improving this Privacy Policy, please send an email to communications@mylan.com or write to us at the address below.

CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may revise this Privacy Policy, so review it periodically.

Posting of Revised Privacy Policy We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically.

New Uses of Personal Information From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive or if we undertake a new use for Personal Information than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
